Section 1
THE BUYER:
1. The BUYER shall NEVER surrender the cat/kitten to a pet shop,
humane society, animal shelter or any other place of similar characteristics.
Neither shall the BUYER surrender the cat to be studied for scientific
or research purposes.
2. The BUYER shall not exhibit the cat/kitten at Cat Shows without
the authorization of the BREEDER (see marked box above).
3. The BUYER shall maintain the cat/kitten in optimum conditions,
providing all required for the physical and psychological well
being of the cat/kitten.
4. The BUYER shall take the cat/kitten to the veterinarian whenever
there are any signs of illness or disease.
5. The BUYER expressly states herein that the cat/kitten shall
remain INDOORS only.
6. The BUYER shall always keep the BREEDER informed of the whereabouts
of the cat/kitten and shall notify the BREEDER of any change of
address, telephone number, etc.
7. Should the BUYER place the cat/kitten with a third party (hereinafter
NEW OWNER) in the future, the BUYER shall make every effort to
assure the well being of the cat and suitability of the new home.
The BUYER shall inform the BREEDER of said new ownership and make
the NEW OWNER aware of this Agreement. All terms and conditions
of this Agreement shall be transferred to the NEW OWNER, who shall
be fully responsible for compliance with the same.
8. Should this cat be a breeding cat, the BUYER shall inform
the BREEDER of transfer of ownership and/or leasing and shall
obtain the permission of the BREEDER before proceeding with the
transaction.
9. The BUYER shall notify the BREEDER of any future health problem
that could be hereditary or genetic. (see Section 2, point 4).
10. The BUYER shall not breed the cat unless sold as a breeding/show
cat.
11. Should the BUYER fail to comply with any of the terms and
conditions of this Agreement, the BREEDER has the right to reclaim
the cat/kitten and any offspring born in breach of this agreement
at any time and with no compensation to the BUYER.
Section 2
THE BREEDER:
1. The BREEDER shall deliver the cat/kitten in optimum conditions
of health, with pertinent vaccinations.
2. To ensure health of the cat upon purchase:
· The BREEDER shall provide a Veterinary Certificate of Health
issued within 10 days prior to the date of sale, or
· The BUYER shall take the cat to their veterinarian within 48
hours following receipt of the cat/kitten.
The BUYER shall immediately inform the BREEDER of the results
of said examination. Should any health problems be found, the
BREEDER shall be liable for veterinary costs up to but not exceeding
the purchase price. Should the BUYER fail to take the cat to the
veterinarian within 48 hours and duly inform the BREEDER in writing
of the results of the same within one week following date of purchase,
the BUYER shall be exonerated of all health commitments herein.
3. The BREEDER shall notify the BUYER, at the end of this Agreement
(Annex), of any possible illness, health problem or behavioural
disorder the cat/kitten does or could suffer. The BUYER understands,
accepts and is fully liable for any future problems inherent to
the condition and exonerates the BREEDER from the same. As the
BREEDER can not know the future care the BUYER will provide to
the cat/kitten, the BREEDER shall not be liable for any illness,
health problem or behavioural disorder that could occur in the
future, with the exception of financial compensation in the case
of Point 5 below.
4. The BREEDER shall accept the return of the cat/kitten for
a period of 7 days following the date of purchase for dissatisfaction
of any kind. In this case only, the BREEDER shall return the full
purchase price. If shipping is required, shipping costs shall
be equally divided between the BREEDER and the BUYER.
5. The BREEDER shall return the price of the cat/kitten should
the animal develop a serious GENETIC illness/problem during the
first two years of the cat's life. The consideration of GENETIC
shall be subject to the evaluation of the BREEDER's veterinarian,
the BUYER's veterinarian and, if required, a third veterinarian
unrelated to either party. The BREEDER shall not be liable for
veterinary or any other expenses exceeding the purchase price
of the cat/kitten, and the financial liability of the BREEDER
shall be limited to the return of the purchase price of the cat/kitten.
NOTE: This clause is NOT applicable for Feline Infectious Peritonitis.
6. In no other case except for 3 and 4 above shall the BREEDER
return the total or partial price of the cat/kitten. Nevertheless,
should there be a genetic illness/problem, the BREEDER has the
option to offer a new cat/kitten to the BUYER instead of the purchase
price, if the BUYER so wishes. In all cases the final decision
to offer a cat/kitten instead of the purchase price of the original
cat/kitten shall always be to the discretion of the BREEDER.
7. The BREEDER will ALWAYS accept the return of the cat should
the BUYER not be able to keep the animal or find a suitable NEW
OWNER if the need arises. Nevertheless, in this case the BUYER
has no right to any compensation from the BREEDER.
8. If the cat/kitten is for showing, the BREEDER does not guarantee
the temperament or success of the animal in the show hall.
Section 3
Terms and Conditions
The following shall be applicable to the type of cat considered
:
Neutered pet
· Registration papers, pedigree and vaccination information shall
be provided upon purchase.
· This cat may not be shown or bred.
Pet with spay/neuter agreement
· Vaccination information shall be provided upon purchase.
· This cat may not be shown or bred.
· Registration papers and pedigree shall be sent upon receipt
of veterinary confirmation of spay/neutering.
· The BUYER shall have the cat spayed/neutered by the age of 8
months at the latest.
· The sum of $_______ shall be returned to the BUYER upon receiving
proof of spay/neuter.
Show alter cat
· Vaccination information, pedigree and registration papers shall
be provided upon purchase.
· BUYER shall keep the BREEDER advised of the show progress of
the cat.
Breeding cat
· Vaccination information, pedigree and registration papers shall
be provided upon purchase.
· After receiving BREEDER approval, the BUYER shall breed this
cat only to other American Curls or Domestic Outcrosses. Under
NO circumstance shall the BUYER breed this cat to any breed other
than the aforementioned.
Show cat
· Vaccination information, pedigree and registration papers shall
be provided upon purchase.
· The BUYER shall seek the advice of the BREEDER before breeding
this cat.
· BUYER shall keep the BREEDER advised of the show progress of
the cat.
Additional for the Breeding/Show cat:
· Compensation for this animal shall be as indicated:
· Purchase price only __________

· Purchase price plus kitten back from breeding of this cat __________
· Purchase price plus kitten back from breeding of other cats

This Agreement, consisting of the front and back of this page,
is signed in duplicate, one copy for the BUYER and the other for
the BREEDER, on the date of _____________________ . If faxed,
both parties recognize the facsimile copy as an original.
